Supreme Court Sends Calexico vs IID to Trial PDF Print E-mail

Calexico, California - This morning the California Supreme Court denied the Imperial Irrigation District’s Petition for Review in the City of Calexico’s lawsuit against the IID regarding the IID’s 2005 municipal water rate increase.

 

Late last year, the City of Calexico successfully appealed a dismissal by the trial court in this case to the Fourth District Court of Appeal. In its December 2007 decision, the Court of Appeal ruled that the lawsuit regarding the IID’s increase in municipal water rates should be returned to the trial court to determine the merits of the case.

Shortly after the Court of Appeal’s ruling and prior to the case returning to the trial court, the IID filed this Petition for Review with the California Supreme Court seeking to have the Supreme Court review and overturn the Court of Appeal’s decision. The City of Calexico answered the IID’s Petition urging the Supreme Court to deny review. Since the Supreme Court has now denied review, the Court of Appeal’s decision will stand and the case will return to the trial court so that the City of Calexico will have the opportunity to challenge the IID’s improper water rate increase.
